Terms of Use

These terms govern your use of the Canvas website and hosting services. Opening an account means accepting them. We have tried to keep them short and to avoid the clauses that exist only to make a dispute expensive.

The service

We provide hosting, domain registration and related services as described on this site and in your order. We may change how a service is delivered, but we will not reduce what you have paid for during a term you have already bought.

Your account

You are responsible for what happens under your account, including anything done by team members you invite. Keep credentials secret, use two-factor authentication, and tell us promptly if you think an account has been compromised. We would much rather help early.

You must be able to enter a contract in your jurisdiction, and the billing details you give us must be accurate.

Acceptable use

A small number of things will get an account suspended, and we would rather be explicit than vague.

• Anything illegal in the jurisdiction the data centre sits in
• Sending unsolicited bulk email from our network
• Phishing, malware distribution or credential harvesting
• Deliberately attacking other networks from our address space
• Content that sexually exploits children, without exception or appeal

Outside that list we are not the arbiter of your content. We will not suspend a site because someone found it disagreeable, and we will tell you who complained where the law allows it.

Resource use

"Unmetered" transfer means there is no cap and no overage charge, not that a single account may consume a whole machine. If your usage begins to affect others on shared infrastructure we will contact you and help move the workload to a cloud instance. We do not throttle first and explain afterwards.

Payment

Fees are charged in advance and are due on the invoice date. Failed payments are retried over ten days with email notice at each attempt; after that the service is suspended, and after a further thirty days it is deleted. Domains follow the registry redemption timetable, which we do not control.

The thirty-day money-back guarantee covers hosting fees only. Domain registrations, dedicated SSL certificates and add-on services already delivered are not refundable, because we have already paid for them on your behalf.

Service levels and credits

The uptime commitment and the credit schedule are set out on the status page and in the FAQs. Credits are the sole remedy for missed availability, and they are applied automatically.

Your data and your rights to it

Your content stays yours. We claim no licence over it beyond what is technically necessary to host, cache, back up and transmit it on your instruction. You can export everything at any time, and closing the account does not require our permission or a phone call.

Liability

Neither party excludes liability for death, personal injury or fraud. Beyond that, our aggregate liability in any twelve-month period is limited to the fees you paid us in that period, and neither party is liable for indirect or consequential loss.

Backups are a service we provide and test, not a warranty against every possible loss. Keep an off-platform copy of anything you could not bear to lose. That is true of every host, including this one.

Ending the agreement

You may cancel at any time from the control panel, effective at the end of the current period. We may terminate for a material breach of the acceptable use section, or with sixty days' notice for any other reason, refunding the unused portion of anything you have paid.

Governing law

These terms are governed by the laws of the State of California, and the courts of San Francisco have exclusive jurisdiction. Nothing here removes a consumer protection that the law of your own country gives you and does not allow to be waived.

Changes

We will give account holders thirty days' notice by email before a material change takes effect. Continuing to use the service afterwards accepts it; if you would rather not, cancel within that window and we will refund the unused portion.
